The agreement that governs your use of Discoverability Engine. Effective from 1 April 2026.
Welcome to Discoverability Engine, a product under Cobaltqube Media Pvt. Ltd. ("Company," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our product, platform, software, APIs and related services (collectively referred to as the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must discontinue use immediately.
Eligibility
You must be at least 18 years old and capable of entering into legally binding agreements to use our Services.
Our Services may be subscribed to and used by individuals and professionals, including but not limited to: businesses and enterprises; startups and small businesses; marketing agencies and consulting firms; freelancers and independent professionals; content creators, publishers and website owners; researchers, educators and students; and any other lawful individual or organization seeking to use the Services for professional or personal purposes.
If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.
By accessing or using the Services, you confirm that you meet the eligibility requirements set forth in this section.
Scope of Services
Our platform provides services including, but not limited to: Generative Engine Optimization (GEO); AI Discoverability Analysis; Brand Visibility Monitoring across AI and Search Platforms; Content Optimization Recommendations; Technical SEO and Structured Data Analysis; AI Citation and Mention Tracking; Agentic Experience Optimization; Analytics and Reporting Tools; and API-based integrations and automation services.
We reserve the right to modify, discontinue, or enhance any part of the Services without prior notice.
User Accounts
You are required to create an account to access the product. You agree to: provide accurate and complete information; maintain the confidentiality of your credentials; notify us immediately of unauthorized access; and accept responsibility for activities occurring under your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use Policy
You agree not to: use the Services for unlawful purposes; attempt unauthorized access to systems, networks, or data; reverse engineer, copy, distribute, or exploit proprietary technologies; upload malicious software, malware, or harmful code; interfere with the operation or security of the platform; or use automated systems in ways that create unreasonable load or abuse the Services.
Violation of this section may result in immediate suspension or termination.
Intellectual Property Rights
All content, software, algorithms, trademarks, logos, designs, documentation, reports, and proprietary technologies provided through the Services remain the exclusive property of the Company or its licensors.
Nothing in these Terms grants you ownership rights to any intellectual property.
You may not: copy or reproduce proprietary materials; modify or create derivative works; or sell, sublicense, or redistribute any portion of the Services without explicit permission.
Customer Content
You retain ownership of content, data, documents, prompts, website information, and other materials submitted to the platform ("Customer Content").
By using the Services, you grant us a limited, non-exclusive license to process such content solely for: providing the Services; generating analytics and reports; improving platform functionality; and delivering customer support.
We do not claim ownership of Customer Content.
Third-Party Platforms and AI Systems
The Services may integrate with or analyze third-party systems, including: search engines; generative AI platforms; Large Language Models (LLMs); social networks; analytics providers; and external APIs.
We do not control such third-party services and cannot guarantee their availability, the accuracy of their outputs, continued support for integrations, or future changes in their algorithms or policies.
Your use of third-party services remains subject to their respective terms and conditions.
AI-Generated Insights, Recommendations and Model Usage
The Services may provide AI-generated analyses, recommendations, predictions, content suggestions, optimization guidance, or other outputs derived from third-party artificial intelligence platforms and models.
Such outputs are provided for informational and operational purposes and do not constitute legal or financial advice. They may contain inaccuracies, omissions, or incomplete information completely based on AI output, and should be independently reviewed before implementation or reliance. Users remain solely responsible for decisions made based on AI-generated outputs.
Model Selection and Availability — To provide high-quality and continued Services, we may utilize what we determine to be the most appropriate, capable, or commercially available AI models across various platforms. For example, these may include intermediate, premium or flagship models offered within the Claude, OpenAI, Google or other AI ecosystems.
The selection, replacement, upgrade, or modification of AI models used within the Services shall remain solely at our discretion and may change from time to time without prior notice to users, aimed at providing best results. We do not guarantee the use of any specific model, model version, provider, or underlying technology unless expressly agreed to in a separate written agreement.
Customers requiring dedicated model preferences, transparency regarding model selection, custom AI configurations, or contractual commitments concerning the use of specific models may request such arrangements through our Agency or Enterprise plans, subject to commercial and technical feasibility and separate agreement with our team.
Variability of AI Outputs — Users acknowledge that artificial intelligence systems are inherently probabilistic in nature. Responses, analyses, recommendations, citations and other outputs may vary across different AI platforms, models, model versions, configurations, prompts, contexts, and individual executions.
The same or substantially similar prompts may produce different outputs, rankings, recommendations, citations or interpretations over time or across separate runs. Accordingly, the Company does not guarantee identical, consistent, or reproducible results from any third-party AI platform or model.
Users further acknowledge that changes implemented by third-party AI providers, including updates to algorithms, training data, model architectures, safety mechanisms, or platform policies, may affect the outputs generated through the Services without prior notice.
Any insights, recommendations, or analytics provided by the Services should therefore be interpreted as indicative and informational in nature rather than as guaranteed or deterministic outcomes.
Subscription and Payment Terms
If paid plans are offered: fees shall be charged according to the selected subscription plan; payments are generally non-refundable unless otherwise required by law; failure to pay may result in suspension or termination of Services; and we reserve the right to modify pricing with reasonable prior notice.
Additional commercial terms may be governed through separate agreements or order forms.
Confidentiality
Both parties agree to maintain the confidentiality of non-public information disclosed during the course of using the Services.
Confidential information shall not be disclosed to third parties except: with prior written consent; when required by law; or to authorized service providers under confidentiality obligations.
Privacy
Our collection, processing, and use of personal information are governed by our Privacy Policy.
By using the Services, you consent to such processing in accordance with applicable laws and regulations.
Service Availability
We strive to provide uninterrupted Services but do not guarantee continuous availability, error-free operation, or compatibility with all devices or systems.
We may conduct maintenance, upgrades, or emergency actions that temporarily affect service availability.
Disclaimer of Warranties
The Services are provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy of data or analytics, and continuous or error-free operation.
We do not guarantee specific business, SEO, GEO, or AI discoverability results.
Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for indirect damages, consequential damages, lost profits, lost business opportunities, data loss, or interruption of operations.
Our aggregate liability shall not exceed the fees paid by you for the Services during the current one month.
Indemnification
You agree to indemnify and hold harmless the Company, its directors, employees, and affiliates from claims arising from: your misuse of the Services; violation of these Terms; violation of applicable laws; or infringement of third-party rights.
Termination
We may suspend or terminate access to the Services if: these Terms are violated; fraudulent or unlawful activities occur; or continued access creates security or operational risks.
Upon termination, your rights to use the Services immediately cease.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict-of-law principles.
Any disputes shall be subject to the exclusive jurisdiction of the courts located in Gurugram, Haryana, India.
Changes to These Terms
We may modify these Terms from time to time.
Updated versions will be posted on this website, and continued use of the Services constitutes acceptance of such changes.
